Terms of Service

These terms are an agreement between your business ("you") and FittersIQ, NIF Z0341705E ("FittersIQ", "we"). By creating an account or using FittersIQ you accept them on behalf of your business. FittersIQ is for business use only.

1. The service

FittersIQ is online software for fitting businesses: Studio for planning jobs, drawings, panels, cutting lists and QR labels; Mobile for fitters on site; and cloud saving and backup between them. We may improve and change the service over time. If we remove something important you rely on, we will tell you in advance.

2. Your account

• The person who signs up is the account owner and can add users up to the number of seats in your plan.
• Keep sign-in details private. You are responsible for what happens under your account.
• Give correct details and keep your email address up to date; we use it for important messages.

3. Free trial

• New accounts start with a free trial. The length is shown in your account and we may extend it.
• We remind you 3 days before the trial ends.
• If no plan is paid when the trial ends, access stops 7 days later. Your data is not deleted at that point; it is kept as described in our Privacy Policy, and access comes back as soon as you pay.

4. Plans, prices and payment

• Prices are set in euro. You can pay in euro, British pounds or US dollars; the price in pounds or dollars is shown before you pay.
• VAT or other sales tax is added where the law requires, depending on your country and VAT number.
• If you continue after the trial, your plan is billed monthly in advance and renews each month until you cancel. Until card payment is available, we invoice you and you pay by the due date.
• If a payment is late, we may suspend access after telling you. Your data is kept while suspended.
• We may change prices with at least 30 days' notice; the new price applies from your next renewal.

5. Cancelling

You can cancel at any time by emailing hello@fittersiq.com or in your account once available. Access continues until the end of the month you have paid for; there is no further charge. Payments already made are not refunded unless the law requires it. Before your account closes you can download a full backup of your data.

6. Your data

• Your jobs, drawings, photos and customer details belong to you. We only use them to provide the service, as set out in the Privacy Policy.
• You must have the right to put your customers' details into FittersIQ, and you are responsible for them under data protection law. Section 11 of the Privacy Policy is our data processing agreement with you.
• Studio and Mobile keep work on your own devices too. Work that has not yet been backed up to the cloud exists only on that device. Keep the company backup switched on and act on backup warnings; we cannot recover work that never reached the cloud.

7. Fair use

Do not: break the law with FittersIQ; try to get into other companies' data; overload, attack or reverse-engineer the service; share accounts beyond your seats; or resell FittersIQ without our written permission.

8. Availability and support

We work to keep FittersIQ available and backed up, but we cannot promise it will always be available or free of errors. Planned maintenance will be announced where possible. Support is by email at hello@fittersiq.com and through Help in the app.

9. Your responsibility for fitting work

FittersIQ helps organise information. You remain responsible for checking measurements, materials, safety and the quality of the fitting work.

10. Liability

• Nothing in these terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or fraud).
• We are not liable for lost profits, lost business, or indirect or consequential loss.
• Our total liability in any 12 months is limited to the amount you paid us in those 12 months.

11. Ending the agreement

We may suspend or close an account that seriously or repeatedly breaks these terms or does not pay, after warning you where reasonable. If we ever stop the service, we will give at least 60 days' notice and let you download your data.

12. Changes to these terms

We may update these terms. For important changes we will tell the account owner at least 30 days before they apply. If you do not agree you can cancel before then.

13. Law

These terms are governed by Spanish law, and the courts of Palma de Mallorca have jurisdiction, unless the law gives you a right to use other courts.
